1. Acceptance of Terms

By accessing and using RentForms (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. In addition, when using this Service, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this Service will constitute acceptance of this agreement.

2. Description of Service

RentForms is a web application designed to help landlords efficiently screen and select prospective tenants before scheduling in-person property visits. The Service allows you to:

• Create and customize rental application forms for your properties
• Share form links with prospective tenants via rental advertisements
• Collect and review tenant applications through your dashboard
• Manage applicant status and communications

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use the Service only for lawful purposes and in accordance with these Terms
• Maintain accurate and up-to-date account information
• Notify us immediately of any unauthorized access to your account
• Comply with all applicable housing laws and regulations in your jurisdiction

4. RentForms as Service Provider

RentForms is a software platform only. We provide tools to facilitate the rental application process, but we are not landlords, property managers, housing providers, or rental decision-makers.

You acknowledge and agree that:

• RentForms does not participate in, influence, or make rental decisions on your behalf
• You are solely responsible for how you use the Service and the decisions you make
• RentForms makes no representations regarding the legality of your screening criteria or decisions
• You are solely responsible for compliance with all applicable laws and regulations
• RentForms does not verify, validate, or guarantee the accuracy of information submitted by applicants

5. Fair Housing Compliance

You must comply with all applicable fair housing laws, including but not limited to the Fair Housing Act. Discrimination based on race, color, national origin, religion, sex, familial status, or disability is strictly prohibited.

You are solely responsible for ensuring your use of the Service complies with all applicable federal, state, and local housing laws and regulations, including but not limited to fair housing laws, privacy regulations, and tenant screening requirements.

6. Prohibited Uses

You agree not to use the Service for any of the following purposes:

• Discriminatory practices prohibited by fair housing laws
• Collecting personal information for purposes other than legitimate tenant screening
• Spamming, phishing, or sending unsolicited communications
• Any illegal or unauthorized purpose
• Attempting to gain unauthorized access to the Service or its related systems
• Interfering with or disrupting the Service or servers or networks

7. Data Ownership and Retention

You retain ownership of all data you submit to the Service, including rental forms and applicant information. When you delete a form:

• Forms are soft-deleted and hidden from your dashboard
• Data is retained internally for audit, support, and compliance purposes
• You may request permanent deletion by contacting our support team

8. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, RentForms disclaims all warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranties regarding the availability, reliability, or accuracy of the Service
• Any warranties that the Service will be uninterrupted, secure, or error-free
• Any warranties regarding the accuracy or completeness of applicant information
• Any warranties that defects will be corrected

RentForms makes no guarantees regarding the suitability of any applicant or the legality of your screening practices. You use the Service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, RentForms and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers or your data
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or malicious code that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred from such content
• Claims by applicants or third parties arising from your use of the Service

IN NO EVENT SHALL RENTFORMS' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless RentForms, its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of any rights of another party, including applicants
• Your violation of any applicable laws, including fair housing laws, privacy regulations, or anti-discrimination laws
• Your rental decisions, screening criteria, or interactions with applicants
• Any content or data you submit to the Service
• Claims by applicants related to your use of their information

11. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution

Before filing a claim, you agree to contact us through our contact page and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days of receiving notice.

Binding Arbitration

If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that:

• You may assert claims in small claims court if they qualify
• Either party may seek injunctive or equitable relief in court to prevent infringement of intellectual property rights

The arbitration will be conducted by a neutral arbitrator in accordance with the rules of a recognized arbitration organization. The arbitrator's decision will be final and binding.

Class Action Waiver

YOU AND RENTFORMS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RentForms is registered, without regard to its conflict of law provisions.

Subject to the arbitration provisions above, you agree to submit to the personal and exclusive jurisdiction of the courts located in that jurisdiction for resolution of any disputes.

13. Force Majeure

RentForms shall not be liable for any failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and RentForms concerning the Service and supersede all prior agreements and understandings.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on our Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
